Terms of Service

Welcome to Mutually. These Terms of Service ("Terms") form a binding legal agreement between you and Mutually Inc. ("Mutually," "we," "our," or "us") governing your access to and use of the Mutually app, website, and related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms in full. If you do not agree, do not use Mutually.
1. Eligibility
You must be at least 13 years old to use Mutually. By accepting these Terms you represent that you meet this minimum age requirement. Users aged 13–17 must have parental or guardian consent. We reserve the right to verify age and to suspend accounts we believe belong to users under 13.
By using the Service you represent that you have the legal capacity to enter into a binding contract and that you are not prohibited from using the Service under the laws of your jurisdiction.
2. Account Registration
You must register for an account to access most features. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and notify us immediately of any unauthorized access
- Be responsible for all activity that occurs under your account
You may not create accounts using automated means, create multiple accounts to evade a suspension, or impersonate another person or brand.
3. The Mutually Platform
Mutually is a creator-networking platform designed to help content creators, influencers, and emerging voices:
- Discover collaborators who share their niche and content style
- Propose and manage collaboration campaigns
- Grow their audiences through authentic, creator-to-creator engagement
- Access tools that measure and improve collaborative reach
Mutually is a platform for genuine creator collaboration — not for artificial follower growth, purchased engagement, or spam. Use of the platform for those purposes violates these Terms and our Community Guidelines.
4. User Content
You retain ownership of content you post, upload, or transmit on Mutually ("User Content"). By posting User Content you grant Mutually a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, reproduce, display, and distribute that content solely to operate and improve the Service.
You represent and warrant that:
- You own or have the necessary rights to the User Content you post
- Your User Content does not infringe any third-party intellectual property, privacy, or publicity rights
- Your User Content complies with these Terms and our Community Guidelines
We may remove User Content that violates these Terms without prior notice.
5. Prohibited Conduct
You agree not to:
- Post content that is illegal, defamatory, harassing, threatening, or sexually explicit
- Use bots, scrapers, automated scripts, or fake accounts
- Purchase, sell, or exchange followers, likes, comments, or any form of fake engagement
- Spam other users with unsolicited messages or collaboration requests
- Impersonate any person, creator, brand, or Mutually employee
- Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
- Violate any applicable laws including copyright, trademark, privacy, and anti-spam legislation
- Interfere with or disrupt the integrity or performance of the Service
- Harvest, scrape, or collect personal information about other users without consent
Violation of these prohibitions may result in immediate account suspension or termination.
6. Payments and Subscriptions
Certain Mutually features may be offered as paid subscriptions or one-time purchases. All payments are processed securely by Stripe. By making a purchase you agree to Stripe's terms of service.
Subscription fees are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period and you will not receive a pro-rated refund for unused time unless required by applicable law.
We reserve the right to change pricing with at least 30 days' notice to subscribers. Continued use after a price change constitutes acceptance of the new pricing.
7. Intellectual Property
Mutually and its licensors own all right, title, and interest in the Service, including all software, design, trademarks, logos, and visual interfaces. These Terms do not grant you any right to use our intellectual property except as necessary to use the Service as intended.
If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or compensation to you.
8. Third-Party Services
The Service may integrate with or link to third-party services (e.g. Instagram, TikTok, YouTube, Stripe, Google). These third-party services are governed by their own terms of service and privacy policies. Mutually is not responsible for the practices of third-party services and we encourage you to review their policies before connecting them to your account.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Mutually does not guarantee any specific outcome from using the platform, including growth in followers, engagement, or revenue from collaborations.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Mutually and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Our total liability to you for any claim arising under these Terms shall not exceed the greater of (a) the amount you paid to Mutually in the 12 months preceding the claim, or (b) CAD $100.
11. Indemnification
You agree to indemnify, defend, and hold harmless Mutually and its affiliates, officers, directors, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
12. Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, for violation of these Terms, our Community Guidelines, or for any conduct we determine is harmful to other users or the platform.
You may delete your account at any time through Settings → Account → Delete Account. Upon deletion, your public profile and content will be removed, subject to our data retention obligations described in our Privacy Policy.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Canada and applicable provincial laws, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration administered under the applicable Canadian arbitration rules.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters involving intellectual property or confidentiality.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 14 days before they take effect. The "Last updated" date at the top reflects the current version. Continued use of Mutually after changes are posted constitutes your acceptance of the revised Terms.
